TERMS & CONDITIONS

These Terms of Service / Terms & Conditions apply to all purchases made through the Taj Étoile website and govern the relationship between Taj Étoile and the customer.
Taj Étoile specializes in evening gowns and occasionwear, including Ready-to-Ship, Made-to-Order and individually customized garments.

“Taj Étoile”, “we”, “us” and “our” refer to Taj Fashion Tailors v.o.f. trading under the Taj Étoile brand.
“Customer”, “you” and “your” refer to the person purchasing products from Taj Étoile.
1. Products
Our collections may include:

Ready-to-Ship gowns
-
Made-to-Order gowns
-
Custom Measurement gowns
-
Individually altered gowns
-
Gowns containing hand-applied embellishments
-
Gowns containing sequins, crystals, stones, beads and other decorative elements
Because many garments involve handwork and detailed craftsmanship, minor variations in embellishment, placement, texture or finish may occur.
Product images represent the design and general appearance of the garment. Colours may vary slightly depending on lighting, photography, screen settings and the customer's device.
2. Orders
By placing an order, you confirm that:

The information you provide is accurate and complete.

The selected product, size and colour are correct.

Any measurements supplied by you are accurate.

You have reviewed the applicable product information.

You agree to these Terms & Conditions.
An order is accepted once Taj Étoile confirms the order or otherwise confirms that the order has been accepted.
We may refuse or cancel an order where there is a reasonable basis to do so, including obvious pricing errors, suspected fraudulent transactions or inability to fulfil the order.
If we cancel an order after payment has been received, the relevant amount will be refunded.
3. Ready-to-Ship Products
A Ready-to-Ship gown is already available in the selected size and does not require individual production before shipment.
Ready-to-Ship does not necessarily mean that delivery is guaranteed within a particular number of days unless a specific delivery commitment has been expressly stated.
4. Made-to-Order Products
A Made-to-Order gown is produced or sourced specifically after an order has been placed.
Made-to-Order status alone does not automatically remove any statutory consumer right.
Where a gown is produced according to the customer's standard selected size without personal modifications, statutory withdrawal rights may apply where required by law.
Where a gown is produced according to personal measurements or individual specifications, the statutory right of withdrawal may be excluded where the applicable legal requirements are satisfied.
Any applicable exclusion will be communicated before the order is placed.
5. Custom Measurements
Customers may be offered the option to provide personal body measurements.
Customers are responsible for providing accurate measurements.
Measurement instructions will be provided where necessary.
If incorrect measurements are supplied by the customer and fitting problems result, those fitting problems may not constitute a manufacturing defect.
Where an error is caused by Taj Étoile, applicable statutory rights remain unaffected.
6. Alterations
Certain gowns may be altered according to customer specifications, including:

Length changes

Fit adjustments
-
Measurement modifications
-
Other agreed individual alterations
An alteration may make a garment individually customized.
Where applicable law permits exclusion of the right of withdrawal for individually customized goods, the customer will be informed before the alteration is confirmed.
7. Prices
Prices are displayed in the currency stated on the website.
Unless expressly stated otherwise, shipping costs are shown separately before checkout is completed.
Applicable taxes are handled in accordance with applicable law and the information displayed during checkout.
Prices may change at any time, but changes do not affect orders that have already been accepted.
8. Payment
Payment must be completed through an available payment method during checkout.
For Made-to-Order and Custom Measurement orders, full payment may be required before production begins.
Production will not begin until the required payment has been received.
9. Production Times
Production times may vary depending on the design, materials, handwork, selected size, Made-to-Order status, custom measurements and requested alterations.
Any production timeframe shown on the website is an estimate unless expressly stated otherwise.
An estimated production timeframe is not automatically a guaranteed delivery date.
If an unexpected material delay materially affects an order, we will inform the customer where reasonably possible.
10. Shipping and Delivery
Orders are shipped to the delivery address provided during checkout.
The customer is responsible for providing a complete and correct delivery address.
Where available, tracking information will be provided after dispatch.
Delivery times depend on the destination, carrier, customs procedures and other circumstances outside our reasonable control.
International orders may be subject to customs duties, import taxes or other charges imposed by the destination country.
11. EU Right of Withdrawal
Consumers residing in the European Union generally have a statutory 14-day right of withdrawal for online purchases, subject to applicable statutory exceptions.
For products, the withdrawal period generally begins after the consumer or a designated third party receives the product.
12. Exceptions to Withdrawal
The statutory right of withdrawal may not apply where a statutory exception applies.
This may include goods that are:

Made according to the consumer's specifications

Clearly personalized
-
Individually customized
-
Otherwise covered by a statutory exception
For Taj Étoile, this may include garments manufactured according to personal body measurements or individually requested specifications.
Simply describing a product as “Made-to-Order” does not automatically exclude withdrawal rights.
Where withdrawal is excluded, the customer will be informed before placing the order.
13. Returns and Refunds
Where a valid statutory withdrawal is exercised, the customer must return the product within the applicable legal period.
The product should be handled only as necessary to establish its nature, characteristics and functioning.
A garment should not be worn for an event, washed, altered, damaged or otherwise used beyond what is reasonably necessary for inspection.
Where legally permitted, the customer may be responsible for diminished value caused by handling beyond what is necessary.
The customer is generally responsible for direct return shipping costs unless otherwise agreed or required by law.
14. Defective or Non-Conforming Products
If a gown arrives damaged, defective or materially different from the product ordered, contact us as soon as reasonably possible.
We may request photographs and a description of the problem so that we can investigate.
Nothing in these Terms & Conditions limits mandatory statutory consumer rights.
15. Cancellation
Customers may contact Taj Étoile to request cancellation before production.
Cancellation is not automatically guaranteed.
Once production has started, or where a product has become individually customized and a statutory withdrawal exception applies, cancellation may not be possible.
Nothing in this section limits mandatory consumer rights.
16. Intellectual Property
All photographs, videos, product designs, graphics, logos, text, branding and other website content are protected by applicable intellectual-property laws.
Content may not be copied, reproduced, modified, distributed or commercially used without prior written permission from Taj Étoile or the relevant rights holder.
17. Privacy
Personal information is processed in accordance with our Privacy Policy.
Information may be processed where necessary to process orders, arrange payment and delivery, communicate with customers, provide customer service and comply with legal obligations.
18. Complaints

Please provide your order number and a clear description of the issue where possible.
Nothing in this complaints procedure limits statutory consumer rights.
19. Liability
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
Mandatory statutory consumer rights remain unaffected.
20. Force Majeure
Taj Étoile is not responsible for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including natural disasters, serious transportation disruptions, strikes, government measures, war, fire, major supplier disruptions, customs delays or other exceptional circumstances.
21. Applicable Law
These Terms & Conditions are governed by Dutch law.
Where a consumer resides in another EU Member State, mandatory consumer-protection provisions applicable in that country remain applicable where required by law.
Disputes will be submitted to the competent court in accordance with applicable law.
22. Changes
Taj Étoile may update these Terms & Conditions from time to time.
The version applicable to an order is the version in force when the order was placed, unless otherwise required by law.
23. Severability
If any provision is found to be invalid, unlawful or unenforceable, the remaining provisions remain in force.
